{"id":16485,"date":"2020-04-15T14:53:55","date_gmt":"2020-04-15T18:53:55","guid":{"rendered":"https:\/\/www.bernierfournieravocats.com\/?p=16485"},"modified":"2026-04-24T11:03:08","modified_gmt":"2026-04-24T15:03:08","slug":"covid-19-minimization-of-non-priority-services-and-activities-for-quebec-businesses","status":"publish","type":"post","link":"https:\/\/www.bernierfournieravocats.com\/en\/covid-19-en\/2020\/04\/15\/covid-19-minimization-of-non-priority-services-and-activities-for-quebec-businesses\/","title":{"rendered":"Essential vs non-essential: Quebec\u2019s COVID-19 measures"},"content":{"rendered":"<p>On March 24, 2020, the Government of Quebec adopted <a href=\"https:\/\/cdn-contenu.quebec.ca\/cdn-contenu\/adm\/min\/sante-services-sociaux\/publications-adm\/lois-reglements\/Decret-223-2020-anglais.pdf?1585098577\" target=\"_blank\" rel=\"noopener noreferrer\">Decree 223-2020<\/a>, thereby making official the order to suspend non-priority services and activities announced on March 23.\u00a0 Under s. 123(2) of the Public Health Act (hereinafter the &#8220;Act&#8221;), the government may, when a state of health emergency has been declared, implement such a measure without delay or other formalities.<\/p>\n<p>With this decree, the Government of Quebec initially ordered to reduce to a minimum, as of Wednesday, March 25th at 00:01 a.m. and until April 13th, 2020, all non-priority services and activities. However, on April 5, the government announced that this containment period would be extended until May 4th, 2020. During this period, the minimum operations required to ensure the eventual resumption of activities of businesses operating in the non-priority sectors may continue, except for businesses that remain covered by the decree.<\/p>\n<p>In addition, businesses where priority services are offered will be authorized to continue their activities. The mandatory continuation of activities also applies to all businesses producing inputs or raw materials needed for priority services and activities. Thus, subcontractors or co-contractors providing products necessary for the priority services and activities will be able to qualify as &#8220;priority services and activities&#8221; within the meaning of the decree. The government has published, in annex to Decree 223-2020, a list of the priority services and activities covered by this exception:<\/p>\n<div id=\"c48419\" class=\" frame frame-default frame-type-textmedia frame-layout-0\">\n<h3>Priority health services and social services<\/h3>\n<div class=\"ce-textpic ce-left ce-above\">\n<div class=\"ce-bodytext\">\n<p>Priority health services and social services, including:<\/p>\n<ul>\n<li>Institutions in the health and social services network, including 811 call centres<\/li>\n<li>Pre-hospital emergency services, including the Corporation d\u2019Urgences sant\u00e9, first responders, ambulance service operators and healthcare communication centres<\/li>\n<li>Private health consulting room of office, including dentists and optometrists (for emergency services only)<\/li>\n<li>Pharmacies<\/li>\n<li>Intermediate resources and family-type resources<\/li>\n<li>Private seniors\u2019 residences<\/li>\n<li>Individuals, enterprises and organizations providing services to the elderly, to the disabled and to the vulnerable, in particular as part of the direct allocation\u2014service employment paycheque measure<\/li>\n<li>Specialized resources offering accommodation for vulnerable groups and their relatives (domestic violence, vagrancy, cancer, addicts housed in community or private resources, palliative and end-of-life care, the underprivileged, immigrants, the elderly, the mentally ill, mother and child, prenatal and postnatal groups, young people in difficulty and their families, people with an intellectual or physical deficiency or an autism spectrum disorder, victims of crime)<\/li>\n<li>H\u00e9ma-Qu\u00e9bec<\/li>\n<li>Transplant-Qu\u00e9bec<\/li>\n<li>Canadian Red Cross<\/li>\n<li>Institut national de sant\u00e9 publique du Qu\u00e9bec<\/li>\n<li>R\u00e9gie de l\u2019assurance maladie du Qu\u00e9bec<\/li>\n<li>Commission des normes, de l\u2019\u00e9quit\u00e9, de sant\u00e9 et de la s\u00e9curit\u00e9 du travail<\/li>\n<li>Wholesalers and manufacturers of medication accredited by the Minister of Health and Social Services<\/li>\n<li>Medical and pharmaceutical laboratories and research centres<\/li>\n<li>Enterprises manufacturing vaccines or by-products to produce vaccines<\/li>\n<li>Suppliers, distributors and co-contractors in the health and social services network<\/li>\n<li>Independent placement agencies in the field of health services and social services<\/li>\n<li>Private IV clinics<\/li>\n<li>Joint procurement groups<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div id=\"c48420\" class=\" frame frame-default frame-type-textmedia frame-layout-0\">\n<h3>Public security services<\/h3>\n<div class=\"ce-textpic ce-left ce-above\">\n<div class=\"ce-bodytext\">\n<p>Public security services, including:<\/p>\n<ul>\n<li>Police departments and police forces, including emergency call dispatch centres (operated by a municipality or the S\u00fbret\u00e9 du Qu\u00e9bec)<\/li>\n<li>Fire services<\/li>\n<li>Correctional services<\/li>\n<li>Special constables<\/li>\n<li>Highway controllers<\/li>\n<li>Wildlife protection officers<\/li>\n<li>Security agencies<\/li>\n<li>Minist\u00e8re de la S\u00e9curit\u00e9 publique (civil security and coroners)<\/li>\n<li>Forest firefighters and all types of professionals class=\"ce-bodytext\">\n<p>Government services and other priority activities, including:<\/p>\n<ul>\n<li>Qu\u00e9bec government departments and bodies<\/li>\n<li>Childcare workers and support staff for emergency childcare services<\/li>\n<li>Online higher education<\/li>\n<li>Suppliers of goods and services for underprivileged citizens<\/li>\n<li>Food inspection and food quality<\/li>\n<li>Waste collection and residual materials management<\/li>\n<li>Government air services<\/li>\n<li>Suicide prevention centres<\/li>\n<li>Assistance services for victims of domestic violence<\/li>\n<li>Services deemed essential by municipal organizations (administration, public works, etc.)<\/li>\n<li>Food banks<\/li>\n<li>Veterinarian clinics\u00a0and agronomists<\/li>\n<li>Production and distribution of medications, vaccines and medical equipment for veterinary medecine<\/li>\n<li>Laboratories and animal health research centres<\/li>\n<li>Care for live animals kept in captivity<\/li>\n<li>Inspection, monitoring and improvements relating to the conservation and health of animals and crops<\/li>\n<li>Courts of justice and administrative tribunals, for matters they deem urgent<\/li>\n<li>Legal services (lawyers, notaries, bailiffs, translators and other workers)<\/li>\n<li>Professional orders \u2013 public protection component<\/li>\n<li>Priority union activities<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div id=\"c48422\" class=\" frame frame-default frame-type-textmedia frame-layout-0\">\n<h3>Maintenance and operation of strategic infrastructure<\/h3>\n<div class=\"ce-textpic ce-left ce-above\">\n<div class=\"ce-bodytext\">\n<p>Maintenance and operation of strategic infrastructures, including:<\/p>\n<ul>\n<li>Energy production, supply, transmission, transportation and distribution (hydroelectricity, fossil fuels, wind energy, biomass energy)<\/li>\n<li>Maintenance of essential public infrastructures in proper working order (bridges, municipal buildings, etc.)<\/li>\n<li>Construction, maintenance and upkeep of essential activities in connection, in particular, with public and private infrastructures that may create a risk for public health and safety (private dams, management of hazardous and radioactive waste, etc.)<\/li>\n<li>Sanitary services and supply chains (for example water treatment plants)<\/li>\n<li>Computer resources (security, maintenance, urgent needs in the current situation)<\/li>\n<li>Data centres<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div id=\"c48423\" class=\" frame frame-default frame-type-textmedia frame-layout-0\">\n<h3>Priority manufacturing activities<\/h3>\n<div class=\"ce-textpic ce-left ce-above\">\n<div class=\"ce-bodytext\">\n<p>Priority manufacturing activities, including:<\/p>\n<ul>\n<li>Food production (agricultural enterprises, including the construction and renovation of agricultural buildings, food processing, drink production, slaughterhouses, market-garden vegetable and horticultural production,\u00a0fisheries and commercial aquaculture)<\/li>\n<li>Production of inputs necessary for priority sectors<\/li>\n<li>Wood products industry and silvicultural operations<\/li>\n<li>Manufacture of medical instruments<\/li>\n<li>Manufacture of chemicals<\/li>\n<li>Manufacture of sanitary products<\/li>\n<li>Manufacture of micro-electronic components<\/li>\n<li>Industrial facilities (in particular in the aluminum sector), which must reduce their activities to a minimum<\/li>\n<li>Manufacturing and maintenance in the defence sector<\/li>\n<li>Mining operations<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div id=\"c48424\" class=\" frame frame-default products)<\/li>\n<li>Businesses supplying agricultural operations (machinery, fertilizer, etc.)<\/li>\n<li>Soci\u00e9t\u00e9 des alcools du Qu\u00e9bec and Soci\u00e9t\u00e9 qu\u00e9b\u00e9coise du cannabis<\/li>\n<li>Furniture and household appliances (online or telephone sales only)<\/li>\n<li>Funeral services business and cemetery<\/li>\n<li>Restaurants (drive-through, take-out and delivery only)<\/li>\n<li>Hotels\u00a0and, to accommodate persons returning to Qu\u00e9bec and not having a fixed residence, camping grounds (only recreational camping vehicles, motorized or not)<\/li>\n<li>Cleaners, laundries and laundromats<\/li>\n<li>Medical and orthopaedic supply firms<\/li>\n<li>Suppliers of pet food and supplies<\/li>\n<li>Moving firms \u00a0and domestic storage<\/li>\n<li>Work equipment (safety and protection)<\/li>\n<li>Products, parts and other equipment necessary for transportation and logistics services<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div id=\"c48457\" class=\" frame frame-default frame-type-textmedia frame-layout-0\">\n<h3>Media and telecommunications services<\/h3>\n<div class=\"ce-textpic ce-left ce-above\">\n<div class=\"ce-bodytext\">\n<p>Media and telecommunications services, including:<\/p>\n<ul>\n<li>Telecommunications (network and equipment)<\/li>\n<li>Cable services<\/li>\n<li>Printing<\/li>\n<li>National media<\/li>\n<li>Local media<\/li>\n<li>Communications agencies (advertising, production, feedback)<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div id=\"c48425\" class=\" frame frame-default frame-type-textmedia frame-layout-0\">\n<h3>Banking, financial and other services<\/h3>\n<div class=\"ce-textpic ce-left ce-above\">\n<div class=\"ce-bodytext\">\n<p>Banking, financial and other services, including:<\/p>\n<ul>\n<li>Financial services (financial institutions, automatic teller machines and other payment methods)<\/li>\n<li>Insurance (telephone services)<\/li>\n<li>Payroll services<\/li>\n<li>Accounting services<\/li>\n<li>Financial market and stock exchange services<\/li>\n<li>Placement agencies<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div id=\"c48426\" class=\" frame frame-default frame-type-textmedia frame-layout-0\">\n<h3>Construction sector services<\/h3>\n<div class=\"ce-textpic ce-left ce-above\">\n<div class=\"ce-bodytext\">\n<p>Construction sector services, including:<\/p>\n<ul>\n<li>Construction firms, for emergency repairs or to ensure safety<\/li>\n<li>Electricians, plumbers and other trades (emergency services only)<\/li>\n<li>Equipment rental firms<\/li>\n<li>Lanscaping and landscape maintenance (including nurseries, garden centres and businesses selling swimming pools)<\/li>\n<li>Construction and renovation of residential dwellings, for any immovable where the taking of possession of a residential unit must take place on or before 31<span class=\"nbsp\">\u00a0<\/span>July<span class=\"nbsp\">\u00a0<\/span>2020, including the supply of goods and services that may be required for the work, including the services of real estate agents, land surveyors, building inspectors and assessors, and chartered appraisers<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div id=\"c48427\" class=\" frame frame-default frame-type-textmedia frame-layout-0\">\n<h3>Building maintenance and upkeep services<\/h3>\n<div class=\"ce-textpic ce-left ce-above\">\n<div class=\"ce-bodytext\">\n<p>Building maintenance and upkeep services, including:<\/p>\n<ul>\n<li>Cleaning, upkeep and pest management<\/li>\n<li>Building maintenance (elevators, ventilation, alarm systems, etc.)<\/li>\n<li>Household appliance maintenance and repair<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<div id=\"c48428\" class=\" frame frame-default frame-type-textmedia frame-layout-0\">\n<h3>Priority services in the field of transportation and logistics<\/h3>\n<div class=\"ce-textpic ce-left ce-above\">\n<div class=\"ce-bodytext\">\n<p>Priority services in the field of transportation and logistics, including:<\/p>\n<ul>\n<li>Public transit services and passenger services<\/li>\n<li>Ports and airports<\/li>\n<li>Maintenance of locomotives, aircraft and boats and essential air operations (air transportation)<\/li>\n<li>Supply and distribution of foodstuffs, grocery stores and convenience stores<\/li>\n<li>Transportation, storage and distribution of goods<\/li>\n<li>Snow removal and road maintenance<\/li>\n<li>Service stations, vehicle maintenance and repair, tow truck firms, trucks and specialized equipment, and roadside assistance<\/li>\n<li>Remunerated passenger transportation, paratransit services\u00a0and rental car firms<\/li>\n<li>Postal, courier and parcel delivery services<\/li>\n<li>Bicycle repair shops, includind, sales<sup>1 <\/sup><\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<p>It is important to note that this list has already been amended and may be amended again. In fact, the Minister of Health and Social Services may, at any time, &#8220;amend the Schedule to add or delete priority services or to make clarifications&#8221;.<\/p>\n<p>Moreover, it is possible for a company whose services are not on the above-mentioned list to apply to the government for designation as a priority company. To do so, companies must submit their application using the online form available here. Plus, the Quebec government has set up a telephone information line on the designation of a priority company, which is accessible by telephone at 1 855 477-0777.<\/p>\n<p>In addition, on March 30th, 2020, the Quebec government decreed <a href=\"https:\/\/cdn-contenu.quebec.ca\/cdn-contenu\/adm\/min\/sante-services-sociaux\/publications-adm\/lois-reglements\/AM_numero_2020-012_anglais.pdf?1585617584\" target=\"_blank\" rel=\"noopener noreferrer\">the closure, for all Sundays in April, of businesses that provide services deemed essential<\/a>, excluding, however, gas stations, convenience stores, pharmacies and take-out orders in restaurants from the application of this measure.<\/p>\n<p>The decree makes it an offence to obstruct or hinder the Minister of Health and Social Services or a Director of Public Health or to refuse to obey an order of either of them. A company that does not comply with government instructions is liable to a fine ranging from $1,000 to $6,000, which is doubled for repeat offences.
